Terms of Service

Effective date: April 12, 2026

1. Agreement

By purchasing or using ContentSpy ("the Software"), you agree to these Terms of Service. ContentSpy is developed and sold by PT INDOGIG HRTECH INDONESIA, a company registered in Indonesia ("we", "us", "our"). If you do not agree to these terms, do not use the Software.

ContentSpy is a software tool for market research and competitive content analysis. The Software provides infrastructure for analyzing publicly available content from social media platforms. Users are solely responsible for determining lawful use cases and ensuring their activities comply with all applicable laws and third-party platform terms.

2. License

Upon purchase, we grant you a non-exclusive, non-transferable license to use ContentSpy on the number of devices specified by your plan:

Starter: 1 device
Pro: 1 device
Agency: 5 devices
Founder Edition: 5 devices

You may deactivate and reactivate on different devices at any time. The license is for your personal or business use and may not be resold or sublicensed.

3. Updates & Version Policy

Update entitlements vary by plan:

Starter: 12 months of updates (current major version).
Pro: 24 months of updates (current major version + all v2.x releases).
Agency: Lifetime updates for the current major version + all v2.x releases.
Founder Edition: Lifetime updates including all future major versions.

After your update entitlement expires, the Software continues to work — you simply won't receive new feature updates. You may purchase an update extension at a discounted rate.

4. Free Trial

We offer a 7-day free trial with full Pro features. No credit card is required. After the trial ends, you may continue using Starter-level features for free or purchase a license to unlock additional features.

5. Payment & Pricing

ContentSpy is sold as a one-time payment. All payments are processed securely by our payment provider (shown at checkout). Prices are listed in USD and may change at any time — however, your purchase price is locked in permanently.

6. Refund Policy

We offer a 14-day no-questions-asked money-back guarantee on all plans. If ContentSpy is not right for you, contact us within 14 days of purchase for a full refund. Refunds are processed to your original payment method.

7. BYOK (Bring Your Own Key)

ContentSpy includes 25 free profile analyses per month via our content analysis engine. For unlimited usage, you may connect your own API keys:

Apify: Free account available. Used for content data retrieval. Subject to Apify's terms.
OpenAI: Paid API. Used for transcription and AI analysis. Subject to OpenAI's terms.

We are not responsible for charges incurred on third-party services. You are responsible for managing your own API keys and usage.

8. Acceptable Use

You agree not to:

Reverse-engineer, decompile, or disassemble the Software
Use the Software to harass, stalk, impersonate, or violate the rights of others
Use the Software to access private accounts or bypass authentication or security measures
Collect, store, or process personal data in violation of data protection laws (GDPR, CCPA, etc.)
Redistribute, resell, or sublicense the Software
Use the Software in violation of applicable laws or third-party platform terms of service

ContentSpy accesses only publicly available content — the same content any user can view by browsing Instagram, TikTok, or YouTube without logging in.

9. User Responsibility & Indemnification

ContentSpy is a market research and content analytics tool. As a user, you are solely responsible for:

Compliance with all applicable laws and regulations — including GDPR, CCPA, CFAA, and any local data protection, privacy, or consumer protection laws
Compliance with the Terms of Service of any third-party platforms (Instagram, TikTok, YouTube, etc.) you choose to analyze through the Software
Obtaining any necessary consents, notices, or lawful bases for data processing under applicable privacy laws
Respecting intellectual property rights of content creators
Using the Software only for lawful purposes such as market research, competitive analysis, and brand monitoring

ContentSpy (PT INDOGIG HRTECH INDONESIA) assumes no liability for:

Misuse of the Software by users
Violations of third-party platform Terms of Service resulting from your use
Data protection or privacy law violations resulting from your use
Claims from platforms, rights holders, or data subjects related to your use
Accuracy, completeness, or availability of third-party data

You agree to indemnify and hold harmless PT INDOGIG HRTECH INDONESIA, its officers, employees, and affiliates from any and all claims, damages, losses, liabilities, costs, or legal expenses (including reasonable attorneys' fees) arising out of or related to your use of the Software in violation of these Terms, applicable laws, or any third-party rights.

10. Intellectual Property

ContentSpy and all related trademarks, logos, and content are the property of PT INDOGIG HRTECH INDONESIA. Your purchase grants a license to use the Software, not ownership of the Software itself.

11. Limitation of Liability

The Software is provided "as is" and "as available" without warranty of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Software. Our total aggregate liability shall not exceed the amount you paid for your license in the 12 months preceding the claim.

12. Termination

We may terminate your license if you violate these terms. Upon termination, you must cease using the Software and delete all copies. Termination does not affect your right to a refund within the 14-day refund window.

13. Changes

We may update these terms from time to time. Material changes will be communicated via email. Continued use of the Software after changes constitutes acceptance of the revised terms.

14. Governing Law

These Terms are governed by the laws of the Republic of Indonesia. Any disputes arising out of or related to these Terms or the Software shall be resolved in the courts of Indonesia, unless otherwise required by mandatory consumer protection laws of your jurisdiction.
